Terms of Service draft
QuizOut Terms of Service.
This draft covers the QuizOut WordPress plugin, hosted quiz-generation service, accounts, plans, and Early Access software.
1. The plugin and the hosted service
The QuizOut WordPress plugin is distributed under the GNU General Public License version 2 or later. That open-source licence governs your right to use, copy, modify, and distribute the plugin code.
These Terms govern access to the QuizOut-hosted generation, account, site-connection, usage, and billing services supplied by [Operator legal name]. Installing the plugin does not require an account, but generating quizzes requires a valid QuizOut site connection and is subject to the applicable free or paid allowance.
2. Accounts and site connections
You must provide accurate account information, keep login and site API credentials secure, and promptly revoke access that should no longer be used. You are responsible for activity under your account and for ensuring that you are authorised to connect each WordPress site.
3. Early Access
Early Access releases are pre-release software. Features, interfaces, compatibility, limits, and availability may change before a stable release. Back up the site and test the plugin on staging before using an Early Access build on a production site.
Early Access may contain defects and may not be suitable for every site. Any final warranty disclaimer, liability limit, and consumer-law wording must be reviewed for the approved jurisdiction before publication.
4. Your content and quiz generation
You keep ownership of your articles, generated quizzes, edits, site data, and branding. You give QuizOut the limited permission needed to process submitted post content, generate and return a quiz, prevent abuse, measure the post allowance, and provide support.
You must have the rights needed to submit the content. You are responsible for reviewing generated quiz content before publication and for the accuracy, legality, accessibility, and suitability of what appears on your site.
5. Acceptable use
Do not use QuizOut to break the law, infringe rights, distribute malware, bypass security or quotas, probe or disrupt the service, share credentials improperly, automate abusive traffic, or generate content that you are not permitted to process. Do not misrepresent generated content as reviewed when review is required for your use case.
6. Plans, quotas, and post packs
A plan sets the number of connected sites and new posts that may receive a quiz during a billing period. A post’s first successful quiz counts once. Editing or successfully regenerating the same post does not use another post allowance. Reader plays, responses, results, analytics, and leads do not count toward the hosted quota.
Prepaid post packs add the stated number of generations and expire 12 months after purchase. They do not change a plan’s site limit or attribution setting. Current plan and pack details appear on the pricing and checkout pages.
7. Subscriptions, payment, and cancellation
Paid subscriptions renew monthly until cancelled. Prices are shown in US dollars and the current pricing page states whether applicable tax is included. Stripe processes payment methods, charges, invoices, and refunds.
Upgrades may apply immediately and downgrades may apply at the next renewal. You can cancel through the account billing controls to stop future renewals. [Final refund eligibility, cooling-off rights, failed-payment handling, and any non-refundable post-pack wording required before publication.]
8. Availability and changes
QuizOut aims to keep generation and account services available but does not promise uninterrupted operation. Maintenance, provider outages, security events, abuse controls, or changes to third-party services may affect availability. Approved quizzes cached by the plugin may continue to work on the WordPress site while generation is unavailable.
QuizOut may change or discontinue features, limits, plans, or Early Access availability. The approved Terms must state what notice applies to material changes.
9. Suspension and termination
You may stop using the service and cancel a paid plan at any time. QuizOut may restrict or suspend access to protect the service, respond to legal requirements, address non-payment, or investigate a material breach. The final Terms must define notice, cure periods, termination rights, and the effect of termination for the approved jurisdiction.
Ending the hosted service does not automatically delete quizzes and reader data stored on your WordPress site. Account export and erasure are handled separately under the Privacy Policy.
10. Ownership and feedback
Except for the GPL-licensed plugin code and your content, [Operator legal name] owns QuizOut’s service, brand, website, documentation, and other proprietary materials. If you provide feedback, QuizOut may use it without restricting your use of your own ideas or content.
11. Legal terms still required
The approved Terms must include final warranty disclaimers, liability limits, indemnity wording if applicable, consumer rights, governing law, court or dispute process, assignment, severability, waiver, notices, entire-agreement wording, operator identity, legal contact, and effective date.
This draft has no legal effect as published Terms and must not be deployed until the complete wording has been approved.
